The key points at a glance
This summary is for orientation only. The full T&Cs below are authoritative.
- We arrange, the clinic treats: Natalie Sarah Plitt Services (CZ-Wellmed) is an intermediary. You conclude the treatment contract directly with the clinic. The clinic or the treating doctor alone is responsible for examination, information, surgery and follow-up treatment.
- Medical decision on site: Whether, how and when surgery takes place is decided exclusively by the treating doctor after a personal examination. Initial assessments and quotes based on your photos are non-binding.
- Honest health information: Please provide all information on your health, pre-existing conditions and medication completely and truthfully. Incorrect or missing information may mean that surgery cannot take place and may result in costs.
- Deposit and booking fee: After the date and price confirmation you pay the surgery deposit and a one-off booking fee of €125 to us within 7 days. We forward the deposit to the clinic. You pay the balance directly at the clinic before the procedure.
- Rebooking and cancellation: Rebooking is possible up to 22 days in advance for €150. In the event of cancellation, in addition to the booking fee, €350 (up to 35 days before), €500 (from 34 days before) or the full deposit (from 48 hours before) is charged. You may prove that less damage has occurred.
- Illness: In the event of sudden illness with a medical certificate, you can postpone once free of charge to a date within 6 months.
- Right of withdrawal: You can withdraw from the booking contract within 14 days. The right of withdrawal expires with the date and price confirmation if you have agreed to early commencement. Details in the withdrawal policy.
§ 1 Scope and role as intermediary
These General Terms and Conditions apply to all contracts between Natalie Sarah Plitt Services, owner Natalie Sarah Plitt, Hochwiesenweg 17, 73102 Birenbach, Germany (hereinafter "Natalie Sarah Plitt Services"), and its customers (hereinafter "patient") for the arrangement of consultation and treatment appointments.
Natalie Sarah Plitt Services acts exclusively as an intermediary between the patient and the clinics or doctors named in the surgery booking order. Natalie Sarah Plitt Services is neither a clinic nor a doctor, does not itself provide any medical services, diagnoses or therapy recommendations and is not a tour operator; no package travel is offered.
Natalie Sarah Plitt Services does not legally represent the clinics and doctors vis-à-vis the patients. The contract for the medical service is concluded directly and exclusively on the basis of a separate treatment contract between the patient and the treating doctor or the clinic at the place of treatment. The clinics and doctors are solely responsible for providing the medical services and are exclusively liable for these services. The clinics and doctors work independently; they are neither employees nor vicarious agents of Natalie Sarah Plitt Services, and Natalie Sarah Plitt Services has no right to issue instructions to them in medical matters.
All medical decisions, in particular on the type, scope, feasibility and timing of a procedure, are made exclusively by the treating doctor on site. A particular treatment outcome cannot be guaranteed.
Deviating terms of the patient do not apply unless Natalie Sarah Plitt Services expressly agrees to them in writing.
§ 2 Arrangement services
Natalie Sarah Plitt Services operates the internet platforms www.cz-wellmed.de, www.brust-op.com, www.liposuktion.org, www.mannop.de, www.med-haarverpflanzung.de, www.plastischechirurgie.net and www.ihr-beautyopberater.de, through which third-party services are arranged for private individuals. Only a brokerage contract is concluded between Natalie Sarah Plitt Services and the patient.
The arrangement service includes in particular: forwarding the patient's enquiry, photos and information to one or more partner clinics, obtaining quotes, coordinating and bindingly reserving the consultation and surgery date, sending the date and price confirmation and organisational support in German.
On request, Natalie Sarah Plitt Services also arranges hotel accommodation and transfer or chauffeur services in connection with arranged surgery dates. These additional services are third-party services. The relevant contracts are concluded exclusively between the patient and the respective provider.
The initial medical assessment and the clinics' quotes are based exclusively on the information and images provided. They are not a binding medical diagnosis, not a commitment that the procedure is feasible and not a guarantee of the result. The final decision is always made only after a personal examination and consultation by the treating doctor on site.
§ 3 Conclusion of contract
By sending the surgery booking order (online, by e-mail or by post) and accepting these General Terms and Conditions, the patient makes a binding offer to conclude a brokerage contract. The contract is concluded when Natalie Sarah Plitt Services accepts the order by sending the written date and price confirmation (by e-mail or post).
The surgery date is agreed between Natalie Sarah Plitt Services and the patient before the signed surgery order is returned. The medical requirements and the availability of the clinic and the treating doctor are taken into account. With the date and price confirmation the patient also receives further travel information and, where applicable, the reservation for a hotel or guesthouse.
§ 4 Requirements for a surgery date
The patient warrants his/her fitness for surgery when concluding the contract and when starting the journey. Fitness for surgery should be established before the journey by an internal medical examination and an ECG by a doctor in private practice. These results must not be older than 14 days on the day of surgery. The final decision on the feasibility of the procedure is made exclusively by the treating doctor on site. If the required documents are not available in time, an internal medical examination can also be arranged on site after consultation and at the clinic's charge.
As a rule, the following will not be operated on: persons under 18, pregnant women and women up to 9 months after breastfeeding, persons who do not consent to a possibly necessary blood transfusion, drug users, persons with HIV or hepatitis B/C, and patients who had surgery under general anaesthesia less than 8 weeks ago. Deviating requirements of the respective clinic will be communicated to the patient and take precedence.
Persons with pre-existing conditions or taking regular medication must disclose this in full in advance and have their fitness for surgery clarified and approved by their GP, internist or treating doctor before the date is agreed. Patients in psychiatric treatment require a current medical certificate of no objection for the planned procedure. For breast operations, a current ultrasound or mammogram with a written report is always required; without this report the procedure cannot be carried out. If necessary, this examination can be carried out on site after consultation.
§ 5 Duties to cooperate and health information
The patient is obliged to provide all relevant information on his/her health, pre-existing conditions, medication, allergies and previous operations completely and truthfully and to follow the clinic's preparation instructions. Deliberate concealment or incomplete or false information may lead to exclusion from the procedure. The resulting costs, in particular cancellation, organisation or loss costs, are borne by the patient in accordance with § 10; the patient retains the right to prove that less damage has occurred.
§ 6 Data protection, photos and health data
Photos and medical information are required for the initial medical assessment. These data, which may be health data, are processed on the basis of the patient's separate, express consent (Art. 9(2)(a) GDPR), which he/she gives in the surgery order or when uploading photos. The data are forwarded exclusively to the respective clinic or doctor. Consent can be withdrawn at any time with effect for the future. Otherwise, the privacy policy applies.
§ 7 Prices, deposit and booking fee
The clinics' prices are fixed "from" prices. The price binding on the patient results from the date and price confirmation. If the actual circumstances on site differ significantly from the information and photos provided, the clinic may adjust the price after a medical examination; the patient then decides whether to have the procedure carried out at the adjusted price.
All clinics and doctors require a surgery deposit before the journey, the amount of which varies depending on the procedure and clinic. The surgery deposit and a one-off flat booking fee of €125.00 must be paid within 7 days of receipt of the date and price confirmation to the following account: VR-Bank Ostalb, IBAN DE19 6149 0150 0034 8570 10, BIC GENODES1AAV. For short-notice dates, payment is due immediately.
The booking fee is the remuneration for the arrangement service of Natalie Sarah Plitt Services. Natalie Sarah Plitt Services receives the surgery deposit in the name and for the account of the respective clinic and forwards it to the clinic (transitory item); it is credited against the treatment price. After forwarding, claims for repayment of the deposit are in principle directed against the clinic. Statutory claims against Natalie Sarah Plitt Services, in particular after an effective withdrawal from the brokerage contract, remain unaffected.
The balance is to be paid directly to the clinic or doctor on site before the operation; the method of payment is stated in the date and price confirmation.
If payment is not received within 7 days of the date confirmation, Natalie Sarah Plitt Services may cancel the date after an unsuccessful reminder and allocate it elsewhere. In this case § 10 applies accordingly.
§ 8 Illness and postponement
If the patient cannot undergo the procedure due to sudden illness, a medical certificate from a doctor in private practice must be submitted. The patient can then postpone the agreed procedure once free of charge, provided the new date is within 6 months of the original surgery date. Any deposit and booking fee not yet paid are due immediately upon confirmation of the postponement.
§ 9 Rebooking
Up to 22 days before the agreed surgery date, the patient can postpone an already fixed procedure and date for a handling fee of €150.00, provided the new date is within 6 months of the original surgery date. Any deposit and booking fee not yet paid are due immediately upon confirmation of the rebooking. Later rebooking requests are treated as a cancellation with a new booking unless the clinic exceptionally agrees.
§ 10 Cancellation by the patient
Cancellations must be made in writing by post or e-mail. Cancellations directly on site at the clinic can also be declared orally to the treating doctor or clinic staff; they are binding and are documented by the clinic.
In addition to the booking fee of €125.00, the following flat-rate cancellation costs are charged: up to 35 days before the agreed surgery date €350.00, from 34 days before the surgery date €500.00, from 48 hours before the surgery date or on the day of surgery the full deposit plus the costs incurred up to that point. Payments already made will be offset.
Not turning up, considerably late arrival, refusal of necessary cooperation and breaking off the agreed procedure on site, in particular without the medical consultation, without examination or without waiting for the medical assessment, are also deemed to be cancellations.
If a date that has already been rebooked or postponed due to illness is later cancelled or not attended, the deposit will be offset as a cancellation fee. The same applies if the patient finally decides against the procedure after a postponement.
In all cases under this section, the patient expressly retains the right to prove that no damage or significantly less damage than the flat rate has occurred.
§ 11 Cancellation or refusal at the clinic
If, after the medical consultation at the clinic, the patient decides against the planned procedure, the clinics or doctors may charge reasonable compensation and costs incurred. The surgery deposit paid will be refunded after clarification with the clinic, less these costs.
The treating doctor or the clinic may also cancel a procedure at short notice if, from a medical point of view, it would be irresponsible to carry it out, or if special circumstances, in particular incomplete information, missing documents, considerable delays or behaviour of the patient that impairs safe treatment, make an operation impossible. Patient safety always comes first.
If the medical examination reveals that the procedure is currently not possible for medical reasons that the patient could not have known beforehand, the deposit will be credited towards the planned procedure on a new date within 6 months; the period may be extended in writing for good cause. If no new date is arranged within this period, the deposit will be refunded less the clinic's proven expenses.
If a procedure is not possible due to culpable conduct on the part of the patient, in particular by concealing illnesses, pre-existing conditions, diagnoses or regular medication, missing documents, late arrival or failure to comply with contractual obligations, the surgery deposit will be retained as a cancellation fee. The patient retains the right to prove that less damage has occurred.
§ 12 Hotel and additional services
Booked hotels, guesthouses or pick-up services can be cancelled free of charge up to 3 days before arrival, unless the respective provider specifies different conditions. In the event of later cancellation or no-show, the full room or pick-up price must be paid; these costs are invoiced separately. The patient retains the right to prove that less damage has occurred.
§ 13 Liability
Natalie Sarah Plitt Services is only liable for the proper provision of the arrangement service. Liability for medical services, treatment results, complications, follow-up treatment, travel services and accommodation is excluded, as these contracts are concluded exclusively between the patient and the respective clinics, doctors or other providers. If, after examination, the treating doctor concludes that the procedure cannot be carried out or can only be carried out in a modified form, this does not give rise to any claim against Natalie Sarah Plitt Services.
Within the scope of the arrangement service, Natalie Sarah Plitt Services is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health based on a breach of duty by Natalie Sarah Plitt Services. In the event of a slightly negligent breach of essential contractual obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on whose observance the patient may regularly rely, liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded. These limitations also apply in favour of the employees of Natalie Sarah Plitt Services.
§ 14 Force majeure and exceptional circumstances
If a surgery date is not possible due to force majeure, official measures, statutory provisions or illness of the intended doctor, the patient will be notified immediately and will receive an alternative date as soon as possible. The deposit will be credited towards the alternative date. If the patient does not accept an alternative date, repayment of the deposit is governed by the statutory provisions; the booking fee remains payable insofar as the arrangement service has already been provided.
§ 15 Informational nature of the information
All information provided by Natalie Sarah Plitt Services in brochures, on websites and in correspondence is based on previous experience with the cooperating doctors and clinics and is for general information only. It never replaces an individual consultation, examination and information session with the treating doctor.
§ 16 Right of withdrawal
Consumers have a statutory right of withdrawal. Details, the model withdrawal form and the online withdrawal function can be found in the separately provided withdrawal policy. The right of withdrawal expires early when the date and price confirmation is sent if the patient has expressly agreed that the arrangement service may begin before the end of the withdrawal period and has confirmed his/her knowledge that he/she will lose the right of withdrawal once the contract has been fully performed.
§ 17 Final provisions
The law of the Federal Republic of Germany applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has his/her habitual residence.
If the patient is a merchant, a legal entity under public law or has no general place of jurisdiction in Germany, the place of jurisdiction is the registered office of Natalie Sarah Plitt Services.
Natalie Sarah Plitt Services is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Should any provision of these General Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provision.
